			<content:encoded><![CDATA[<p>In Washington State, most of the superior courts have adopted a program known as &#8220;mandatory arbitration.&#8221; Arbitration is way to avoid trial and resolve a case. The purpose of Mandatory Arbitration is to reduce court congestion, expedite the litigation process, and to provide a cost effective resolution of civil claims.</p>
<p>The court will appoint an &#8220;arbitrator&#8221; who will listen to testimony, reviewing evidence, decide the case, and issue an award. Typically the arbitrator is an experienced <a href="http://www.articlecube.com/Article/What-is-Mandatory-Arbitration--/217940#" id="KonaLink0" target="_top" class="kLink" style="text-decoration: underline ! important; position: static"><font style="color: green ! important; font-family: Verdana,Arial,Helvetica,sans-serif; font-weight: 400; font-size: 11px; position: static" color="green"><span class="kLink" style="color: green ! important; font-family: Verdana,Arial,Helvetica,sans-serif; font-weight: 400; font-size: 11px; position: static">attorney</span></font></a> or perhaps a retired judge. I have served as an arbitrator in many personal injury cases.</p>
<p>Arbitration is more cost effective, has more relaxed rules of evidence, and the hearing is far less stressful than a jury trial which is why arbitration is often preferred over a jury trial. In addition, the arbitration hearing may be scheduled within four to six months after a lawsuit is filed. In contrast it can take up to two years or more for a case to get to trial. And most arbitration hearings last no longer than a day while a jury trial can last several days or even weeks.</p>
<p>There are potential drawbacks with arbitration. For instance, there is often a limit on the amount of damages that can be awarded. In Washington state (as of late 2007) that limit is now $50,000. Even if your case is worth more than $50,000 it could still be advantageous to participate in mandatory arbitration because of the high costs and risks of going to trial. Another potential drawback is that either party can appeal the arbitration award and request that the case be tried in court. However, if a party appeals the award but fails to do better at trial, that party will have to pay the other side&#8217;s attorney fees and costs (which could be substantial depending on the facts of the case and the length of trial).</p>
<p>In my experience, more than 90% of the arbitration appeals are requested by the defendant&#8217;s insurance company. Most plaintiff attorneys do not like to appeal an arbitration award because it creates a significant risk that the client may have to pay the defendant&#8217;s attorney&#8217;s fees.</p>
<p>Most people fail to recognize is that often <a href="http://www.articlecube.com/Article/What-is-Mandatory-Arbitration--/217940#" id="KonaLink1" target="_top" class="kLink" style="text-decoration: underline ! important; position: static"><font style="color: green ! important; font-family: Verdana,Arial,Helvetica,sans-serif; font-weight: 400; font-size: 11px; position: static" color="green"><span class="kLink" style="color: green ! important; font-family: Verdana,Arial,Helvetica,sans-serif; font-weight: 400; font-size: 11px; position: static">insurance </span><span class="kLink" style="color: green ! important; font-family: Verdana,Arial,Helvetica,sans-serif; font-weight: 400; font-size: 11px; position: static">companies</span></font></a> will intentionally appeal a fair arbitration award to force the plaintiff to incur added expense, which can be substantial, of taking the case to court. Why? Because insurance companies want to make it as expensive and time consuming as possible in order to wear down the plaintiff and their attorney. In fact, many insurance companies will routinely spend more money to defend a case than the amount of money it would take to simply pay the arbitration award.</p>
<p>If the arbitration award is appealed and the case goes to trial, the jury will most likely never be informed that the case was submitted to arbitration. And of course, the jury will never be told the amount of the arbitrator&#8217;s award. This can create problems especially in smaller cases because the jury may be left with the impression that the plaintiff and his or their attorney have forced the jury to come to court to decide a small case. Many times jurors resent having to decide a small case because they believe smaller cases should be settled. Yet jurors never realize until after the trial that it was the defendant&#8217;s insurance company that appealed the award and forced a trial. Fortunately, this author has developed proven trial techniques to combat this problem.</p>
<p>It is important to remember that there are specific rules that govern Mandatory Arbitration. These rules are complex and can provide traps to the inexperienced attorney. <p>• Many candidates for employment ay consider the benefit packages being offered as a major deciding factor, especially on the face of competitive job markets. The organizations usually offer to provide these benefits with the motive of attracting and retaining employees with the highest and impressive qualifications.</p>
<p>The companies&#8217; policy in this matter would be that it is a worthwhile business investment to provide significant perks or awards for employees in order to attract an employee with an advanced caliber. The company finds benefits provision as a necessary investment to attract and retain capable workforce and inspire them to achieve bigger and better for the good of the company.</p>

<p>- Pension and Retirement package – these benefits may not be considered mandatory but if the employer provides for coverage, and then it should follow ERISA regulations and the tax laws.</p>
<p>- Heath care Insurance – not really required by any law but if offered, it must be under the regulations of COBRA or Cal – COBRA and the HIPPA.</p>

Sunstones are found all over the world but the gem quality stones that are large enough to cut for jewelry are normally found in Oregon. Crystals as large as 3 inches across have been found but normaly range from 1/8 to 1 inch long. Oregon is also the only place in the world that this gem grade material is found with copper in it and in 1987 it was declared the official State <a href="http://www.articlecube.com/Article/Treasure-Hunting-For-Sunstones/217925#" id="KonaLink1" target="_top" class="kLink" style="text-decoration: underline ! important; position: static"><font style="color: green ! important; font-family: Verdana,Arial,Helvetica,sans-serif; font-weight: 400; font-size: 11px; position: static" color="green"><span class="kLink" style="color: green ! important; font-family: Verdana,Arial,Helvetica,sans-serif; font-weight: 400; font-size: 11px; position: static">Gemstone</span></font></a> of Oregon.<br />
Rough sunstones will range from about $400.00 to $500.00 a carat and for a good cut and polished one can sell for over $1,000.00 a carat depending on the crat, color, clarity, and cut. In 2006 the travel channel aired a show about the Spectrum Sunstone Mines from the Cash and Treasures series. One of the sunstones found durring filiming, after it was cut and polished it was over 10 carats and was sold to a couple in Oregon for $5,200.<br />
Oregon sunstone are found only in the remote high desert of Lake and Harney counties of Oregon. The U.S. Bureau of Land Management has established a free, public collecting area in eastern Lake County which is near Plush Oregon. Until recently, this was the only known occurrence of the gem quality sunstones found in the United States.<br />
The geology of Harney and Lake county is favorable for the discovery of more deposits of these fine <a href="http://www.articlecube.com/Article/Treasure-Hunting-For-Sunstones/217925#" id="KonaLink2" target="_top" class="kLink" style="text-decoration: underline ! important; position: static"><font style="color: green ! important; font-family: Verdana,Arial,Helvetica,sans-serif; font-weight: 400; font-size: 11px; position: static" color="green"><span class="kLink" style="color: green ! important; font-family: Verdana,Arial,Helvetica,sans-serif; font-weight: 400; font-size: 11px; position: static">gem </span><span class="kLink" style="color: green ! important; font-family: Verdana,Arial,Helvetica,sans-serif; font-weight: 400; font-size: 11px; position: static">stones</span></font></a> and recently several more mining claims have been established in the northern and southeastern area of Harney county. These producing areas are not available for public collecting without permission of the claim owners.<br />
Sunstone Knoll south west of town of Delta, Oregon is open to the public and is free. The best time to search for sunstones is just after rain storme. Sunstones glitter in the sunlight and can be found on the ground on the east side of the knoll. The gem stones usuallly range from 1/8 to 1 inch but larger stones have been found.<br />
The Spectrum Sunstone Mine is a 20 acre privately owned patented mining claim located 27 miles northeast of Plush, Oregon which is open to the public bewteen May 15 and November 1. Dig through a pile of fresh unprodcessed ore for free all day with mine personnel to learn how to spot these fine gem stones. Additonal days are available for $50 per day per person. Winter mining are welcomed by appointment only. You may call 775-830-5797 for more information.<br />
You will need to bring a pick ax to used on the walls of a mine to reveal sunstones hidden among loose rocks or within broken rocks. A rock pick or screw driver is used for pyring the gemstones out of the broken rock. A shovel and a five gallone plastic bucket for loading loose dirt and broken rocks to be taken to the screening area for furthur process. You will also need to bring a screen. Loose dirt is shoveled onto a screen. The screen is then shaken to remove small particles and sand.<br />
Watch the screen while shaking it, sunstone will often flash as they roll around. Examinin the screenings with the sun facing you. The sunligh will reflect through the sunstones makeing them easer to spot. Examine the screenings from varous angles and roll the gravel around while doing so. Before discarding the screenings always look from underneath the screen with the sun at your back. Many dusty stones can be missed until you see the light pass through them.<br />

<p>Dinosaurs, of all known animals, are quite popular mystifying creatures and are well identified by children of all ages. Dinosaurs were real and live animals that lived in most regions of the world and were completely wiped out 65 million years ago. The cause of their extinction is still debated but most of the researchers agree that when alive, the dinosaur dominated the wilds. We are aware of their existence by their remains, usually documented in bones, either found as complete skeletons or separately. We have also found their footprints in rock, as well as some eggs rooted in them. Most of the bigger dinosaur specimens have now been collected and displayed in larger museums.</p>
<p>Most of the researchers around the world agree that dinosaurs are one of the larger species that lived in the Age of Reptiles, which was about more than 200 million years ago. It is estimated that the dinosaur age lasted for some 165 million years. During this time period, many types of dinosaurs roamed the wilds. Researchers have successfully come to know the variety of species of dinosaurs that existed during this time. This is done by the study of fossils of dinosaur bones being found out at different places of the world. However, many dinosaurs will never be discovered. This is due to the reason that only very few dinosaur bones are in reality fossilized through the delicate and temperamental process. In such a case, the tiniest dinosaurs and the largest will most likely be a mystery for the rest of time. Till this time, many dinosaur bones have been discovered only a few complete skeletons have ever been found. When scientists try to assemble a skeleton from bones, most of the process involves a large amount of assessment between size and morphology of other bones.</p>
<p>The fossilized dinosaur bones that have been unearthed from different parts of the world have helped us to know more about the mystifying creatures. The fossils of dinosaur bones serve as evidences that most dinosaurs had large bodies. Even the tiniest dinosaurs were bigger than anything else in their ecosystem and the largest dinosaur bones ever found indicate animals on a scale never seen in modern times. Dinosaurs bigger than the 38 ft tall Brachiosaurus found in Tanzania sometime between 1907-1912 have only been indicated by isolated bones.</p>
<p>Dinosaur bones can expose important information about the behavior of the dinosaur in its living environment. Time and again, computer simulations are employed to comprehend how a dinosaur with certain bones might have moved. These simulations compare the bones of the dinosaur with bones from more modern animals and then reconstruct the kinetics of movement based on the shapes of the bones. Because dinosaurs are thought to be more closely related to animals like birds and crocodiles rather than mammals, behaviors from these animals can be used to estimate dinosaur behavior. The analysis of bones used for movement, or Biomechanics, gives scientists information as to how quickly dinosaurs moved, if some dinosaurs could swim, and reveals whether ideas like sonic booms created by the diplodocid tail are fact or fiction.</p>

<p>Even if donor countries at a conference in Paris meet the request for an unprecedented $5.6 billion over three years, it still may not be enough to stem the economic decline in the West Bank and Gaza.</p>
<p>The Palestinian economy can only recover if Israel eases restrictions on Palestinian movement, the World Bank says, but a reluctant Israel putting its security first, has given no guarantees. It&#8217;s simple math for clothing wholesaler Samer Zawiyani, from the West Bank city of Nablus. Shipping costs eat up most of his profits because his trucks wait for hours at checkpoints as soldiers search for bombs.</p>
<p>&#8220;We don&#8217;t need the billions of the world. We need Israel to remove the checkpoints,&#8221; he said.</p>
<p>Aid and freer movement are viewed as essential if the new U.S.-led push for an Israeli-Palestinian peace deal by the end of 2008 is to be spared a serious psychological blow. Negotiations resumed last week, after seven years of diplomatic deadlock and bloodshed.</p>
<p>Given that choice, the representatives of 90 countries and international organizations invited to Monday&#8217;s gathering are expected to come up with the money requested by the Palestinians. Among those making a pitch will be U.S. Secretary of State Condoleezza Rice and international Mideast envoy Tony Blair, the former British prime minister.</p>
<p>The donors say they are aware of the stakes and are urging Israel to be more flexible. &#8220;The political pressure exists, it is being exerted by the Europeans and the Americans,&#8221; said Christiane Hohmann, spokeswoman for EU External Relations Commissioner Benita Ferrero-Waldner.</p>
<p>However, so far only Britain has said it will link disbursement to improved conditions on the ground, including an easing of Israeli restrictions and Palestinian government reform.</p>
<p>Palestinian Prime Minister Salam Fayyad says he is doing his best not to disappoint the donors, who have seen more than $10 billion in aid since 1993 largely go to waste because of mismanagement under the late Yasser Arafat and years of Israeli-Palestinian fighting that destroyed much of what was built with aid money.</p>
<p>Fayyad, a respected economist, has won the support of the World Bank and the International Monetary Fund for his three-year development plan, including promises to trim the oversized public payroll and reduce hundreds of millions of dollars in utility subsidies. The IMF has said the plan is ambitious, but doable.</p>
<p>Fayyad told The Associated Press in Paris Sunday that his government needs a quick injection of cash to get through the next few months and he hopes Arab states will pitch in. Europe, he said, cannot be expected to go much beyond the already considerable amount of aid it has been providing to the Palestinians.</p>
<p>&#8220;This is a point in time where we need cash assistance, and we need it in a hurry,&#8221; Fayyad said. &#8220;As you know, the EU has done quite a bit over the course of this year, raising the level of its cash assistance.&#8221;</p>
<p>Europe is the biggest donor to the Palestinians, providing some $1.4 billion in support in 2007, according to officials in the European Commission.</p>
<p>In 2002, Arab countries had promised to give the Palestinians $55 million a month, but have not disbursed the full amount pledged.</p>
<p>The plan being presented aims to assure donors that they are not expected to prop up the Palestinian Authority indefinitely, even though the bulk of the aid, $3.9 billion, would go toward the government&#8217;s budget deficit. The balance is to shift gradually to development projects, under a scenario that has Israel easing restrictions and enabling the Palestinian private sector to recover.</p>
<p>&#8220;It is difficult for me to see the possibility of normal economic life &#8230;. unless and until there is normalization in the sense of an easing and ultimately removal of restrictions on mobility currently imposed by the state of Israel,&#8221; said Fayyad.</p>
<p>The Palestinian plan formally covers both the West Bank and Gaza, territories on either side of Israel, but the focus is on the West Bank, run by moderate Palestinian President Mahmoud Abbas.</p>
<p>Abbas has no control over Gaza, which was seized by the Islamic militant group Hamas in June and has since been cut off from the world by Israeli and Egyptian border closures. Only basic goods are allowed in, and exports have stopped, except for a few recent shipments of flowers and strawberries.</p>
<p>The blockade has wiped out tens of thousands of jobs and three-quarters of Gazans now live in poverty. However, Israel says easing access is dangerous: its border towns keep getting hit by rocket fire from Gaza and the Iranian-backed Hamas continues to smuggle weapons into the territory through tunnels from Egypt.</p>
<p>In the West Bank, though, Abbas&#8217; security forces are trying to assert control gradually, both over Hamas loyalists and vigilante gunmen linked to Abbas&#8217; Fatah movement, and have made a strong showing in one militant stronghold, Nablus.</p>
<p>Attacks against Israelis emanating from the West Bank have dropped significantly.</p>
<p>However, Israel&#8217;s closure regime, set up after the outbreak of the second Palestinian uprising in 2000, remains in place. West Bankers need hard-to-obtain permits to enter Israel, and Israel&#8217;s separation barrier, about 60 percent complete, slices off nearly 9 percent of the West Bank. Hundreds of roadblocks and barriers crisscross the remainder of the territory, making internal travel and trade difficult.</p>
<p>Israel says it supports the donors&#8217; efforts and understands Abbas&#8217; concerns, but cannot compromise its security.</p>
<p>The central issue for Israel, Prime Minister Ehud Olmert told his Cabinet on Sunday, &#8220;is the Palestinian Authority&#8217;s ability to deal as it should with the subject of security, to eradicate the terror organizations, and ensure there will not be terrorist activity against Israel.&#8221;</p>
<p>Meanwhile, the roadblocks make life miserable for ordinary Palestinians and heighten resentment of Israel.</p>
<p>The oasis town of Jericho used to profit handsomely from tourists. But nowadays a Palestinian family must think twice about visiting there, lest they be trapped at roadblocks.</p>
<p>The World Bank acknowledges what it says are Israel&#8217;s legitimate security concerns, but says the restrictions also exist to protect Jewish settlers in the West Bank &#8220;at the expense of the Palestinian population.&#8221;</p>
<p>Economists say that without the violence and closures of the past seven years, Palestinian gross domestic product could now be double its current $4 billion and make them far less dependent on aid.</p>
<p>The cost of failure is high. Palestinian per capita income is only 60 percent of what it was in 1999, and a further economic decline would weaken Abbas at the expense of Hamas, even in the West Bank.</p>
<p>For the donors, the alternatives are clear, said Joel Toujas-Bernate, head of the IMF in the West Bank and Gaza. &#8220;They don&#8217;t really have a choice but to pledge as needed, but also to try to encourage the Israeli government to do its part.&#8221;</p>

The Turkish military has in  recent weeks increased its cross-border raids against targeted strongholds of the  Kurdistan Workers Party, or PKK. Deputy Prime Minister Cemil Cicek told the state-run  Anatolia news agency that more strikes against were likely in the coming weeks. Ankara  has also stationed more than 100,000 troops along the Turkish-Iraqi border in an attempt  to stop PKK attacks inside Turkey.</p>

However, the vote  was declared valid by the Central Electoral Commission after 61 per cent of the 2.7  million electorate had voted. Kyrgyzstan has suffered political upheaval since 2005, when  mass demonstrations ousted President Askar Akayev from power. As a neighbour to  China and Afghanistan, the former Soviet state is strategically important for both the  United States and Russia.</p>

Police said about 40 Maoists held in the jail in  Chhattisgarh state fled their cells and grabbed rifles before freeing the others.  Reinforcements were sent to the jail and a massive search operation is under way in the  surrounding areas. Chhattisgarh is a stronghold of the rebels, who operate in at least 13  Indian states. The Maoists say they are fighting for the rights of poor farmers and  labourers. Thousands of people, including many paramilitary personnel and police, have  been killed in the insurgency since the late 1960s.</p>

According to military officials the security situation in Basra is stable. The handover  will be the biggest test yet of the Baghdad government&#8217;s ability to maintain security  without troops from the United States or its main ally. However, a scaled-down British  force totalling 2,500 troops will remain in southern Iraq.</p>
